Let us say someone has changed employers after 180 days of 485 application and has no plans to invoke AC21(which is optional) .
1)What is the process to switch attorneys(from Attorney A to Attorney B)?
OR alternatively
2)If we don't want to choose a new attorney, but want all the communictation(such as RFE to come to you), What is the process ?
I read somewhere that you can do this by filing a new G-28, but not sure of the step by step process and the documentation needed.
Appreciate as much details as possible from someone who did this.

My Case Details:
I currently have an H1 and have applied for 485(in July 2007, EB3 India, priority date April 2004, I-140 Approved, EAD approved). My wife also applied 485 (as beneficiary dependent) along with me and is currently working on EAD. Unfortunately my daughter was not in the country in July 2007 and due to unavoidable reasons she was not able to apply for 485 then. She came to US on H4 dependent visa and is currently studying in public school.
My H1B visa and my daughters H4 visa expires in Sept, 2010. I want to use my EAD in case if my H1B extension is not approved in Sept, 2010 and am trying to find out if there were other legal ways for me to have my daughter documented in US.
One of the option I was considering is try to get a F1 Student visa for her. My Daughter is in 10th grade currently (15 years old).
Please advice:
- What would be the best independent status for my daughter ?
- if My daughter converts to a student visa (F1), and some time later EB3 category becomes current for my priority date, then can 485 be applied for my daughter while she is in F1 status ? IN other words are there any issues of her being in non-immigrant intent F1 visa and me applying for 485 for her as my dependent ?
- Is there any limit on the number of years a person can be on F1 Visa in US ? She is currently in 10th grade and might join 11th Grade in F1 visa.
- Does she need to go out of US to change her status from H4 to F1 ?
- In case if required can I convert my EAD status back to H1B ?

Hi,
My I140 got denied early this year and the appeal is pending. Processing times for the appeal is 22 months. My priority date will be current next month. Because of that i am considering to refile my I140 and 485 again and withdraw the appeal.
1) Can we refile I140 with the same category (EB2)
2) Can USCIS just deny the new I140 because of the earrlier denial
3) Is there any one who tried this. What is the outcome of the new I140 application.
Please share your experience and also please advice

While parents apply for a tourist visa, in DS-156 where it says "who will pay for the trip", if they mention "self" do we still have to send an Affidavit of Support.
Secondly, do they have to show sufficient cash in their bank account for the trip or will investment proof be ok.
Thirdly, our extended visa is expiring 28thApr'07 & we've applied for renewal in feb'07. We have n't received the receipt yet. Will our current visa copy be sufficient ?

In my case i filed for I-140 and had a notice to deny bacause they put the worng name on the application....:eek:
we then refiled a second i-140, but processing was stopped on that because they needed the original labor cert. from my first i-140.
i filed on 19th May, and finally got approved on 27th July, although i did file PP.
So i would say a couple of months is about right for the labor cert. to be transferred from one case to another.

It might happen that I might have to go back to India

Could anyone please suggest me a few consulting companies who can sponsor H1B visa? I am trying to bring my friend who is in India working for an automotive OEM. He was in Michigan for a while and he went back to India and it�s been almost more than 7 years since he left but now he wants to come back to Michigan.
If anyone knows any consultants in Michigan would be perfect since I already have a job lined up (verbally) through my contacts but I am not successful finding an employer who can sponsor H1B for him.

H1B petition by consulting companies.
